1.Acknowledgment of Risks

I understand that participation in the Event involves inherent and other known and unknown risks that may result in serious bodily injury, illness, property damage, disability, drowning, or death.

Activities at the Event may include, but are not limited to:

• Traditional sauna and other high-temperature heat exposure;
• Cold-water immersion and cold plunging in Horsetooth Reservoir;
• Repeated or rapid transitions between hot and cold environments;
• Aufguss and other guided sauna experiences;
• Breathwork, meditation, sound therapy, aromatherapy, stretching, movement, and other wellness activities;
• Walking and gathering on outdoor, uneven, wet, slippery, rocky, icy, muddy, or otherwise hazardous surfaces;
• Interaction with other attendees, sauna operators, practitioners, vendors, equipment, structures, and vehicles.

I specifically acknowledge risks including, but not limited to:

• Burns and contact with hot surfaces, heaters, stones, steam, or water;
• Heat exhaustion, heat stroke, overheating, dehydration, dizziness, fainting, nausea, or loss of consciousness;
• Cardiovascular stress or changes in blood pressure or heart rate;
• Cold shock, hypothermia, hyperventilation, loss of motor control, or other reactions to cold-water immersion;
• Drowning or near-drowning;
• Slips, trips, falls, collisions, cuts, bruises, sprains, fractures, or other injuries;
• Adverse reactions associated with pre-existing health conditions, medications, alcohol, drugs, dehydration, or other substances;
• Adverse reactions to essential oils, fragrances, smoke, steam, natural materials, or other substances;
• Exposure to airborne or communicable illnesses;
• Injuries resulting from the actions or omissions of other participants, vendors, practitioners, sauna owners/operators, or other third parties;
• Hazards associated with weather, wind, lightning, precipitation, changing temperatures, wildlife, insects, vegetation, water conditions, and other natural conditions;
• Equipment failure, defects, or malfunction; and
• Other foreseeable and unforeseeable risks associated with attending or participating in an outdoor sauna, cold-water, and wellness event.

I understand that this list does not include every possible risk associated with the Event.

2.Health and Fitness to Participate

I represent that I am at least 18 years old and am physically and mentally capable of participating safely in the activities I choose to undertake.

I understand that sauna use, cold-water immersion, breathwork, and other Event activities may place significant stress on the cardiovascular and respiratory systems.

I understand that certain medical conditions, medications, pregnancy, recent illness or surgery, and other health circumstances may make participation inappropriate or increase my risk of injury.

I am responsible for determining whether I should participate and for consulting a qualified healthcare professional when appropriate.

I will not participate while impaired by alcohol, illegal drugs, or any substance that materially affects my ability to participate safely.

I understand that Event staff, sauna operators, and practitioners are not responsible for determining whether I am medically fit to participate.

3.Personal Responsibility

My participation is entirely voluntary.

I am responsible for monitoring my own physical condition and determining when to enter or exit a sauna, cold plunge, reservoir, or other activity.

I agree to immediately discontinue an activity if I experience dizziness, lightheadedness, difficulty breathing, chest pain, unusual discomfort, confusion, numbness, excessive overheating, excessive cold, or any other concerning symptom.

I agree to follow posted rules and reasonable safety instructions provided by Event staff, sauna operators, practitioners, venue personnel, or emergency personnel.

I understand that I may decline or discontinue any activity at any time.

4.Open-Water Cold Plunge

I specifically acknowledge that entering Horsetooth Reservoir involves risks different from a controlled cold-plunge tub or swimming pool.

Water depth, temperature, footing, visibility, waves, currents, submerged objects, rocks, weather conditions, and other environmental conditions may change and may not be readily apparent.

I voluntarily assume the risks associated with entering the reservoir and understand that entering the water is optional.

I agree to remain within any designated cold-plunge area and comply with all Event and venue rules regarding water access.

5.Assumption of Risk

I knowingly and voluntarily assume all risks associated with my attendance at and participation in the Event, including the risks described above and other known or unknown, foreseeable or unforeseeable risks, except to the extent an injury, death, or other damage results from conduct for which liability cannot legally be waived under Colorado law.

6.Release and Waiver of Liability; Covenant Not to Sue

To the fullest extent permitted by Colorado law, I, on behalf of myself and my heirs, estate, personal representatives, executors, administrators, successors, and assigns, release, waive, discharge, and covenant not to sue:

Foundry Saunas; The Pour Sauna Festival; Larimer County; the Event venue and property owner/manager; and each of their respective owners, members, officers, directors, employees, volunteers, contractors, agents, sponsors, sauna owners and operators, practitioners, instructors, vendors, service providers, and affiliated persons and entities (collectively, the “Released Parties”)

from claims, liabilities, damages, losses, costs, or causes of action arising from or relating to my attendance at or participation in the Event, including claims arising from the ordinary negligence of a Released Party, except to the extent such liability cannot legally be waived under Colorado law.

7.Indemnification

To the fullest extent permitted by law, I agree to indemnify and hold harmless the Released Parties from claims, liabilities, damages, costs, expenses, and reasonable attorneys’ fees arising from my own actions or misconduct during the Event or my violation of Event rules.

8.Personal Property

I am responsible for my own belongings and understand that the Event and Released Parties are not responsible for lost, stolen, misplaced, or damaged personal property except to the extent required by applicable law.

9.Emergency Medical Treatment

If I become injured or ill during the Event and am unable to provide instructions, I authorize Event personnel to contact emergency medical services and authorize reasonable emergency assistance.

I understand that Event personnel are not obligated to provide medical treatment.

I accept financial responsibility for medical treatment, ambulance transportation, hospitalization, or other medical services provided to me.

10.Photography, Video and Media Release

I understand that photographers and/or videographers may be present at the Event and that photography, video, and audio recording may occur in public and common areas.

I grant Foundry Saunas and The Pour Sauna Festival permission to photograph, record, and otherwise capture my image, likeness, and voice while attending the Event and to use such materials for legitimate Event-related promotional, marketing, editorial, social-media, website, and archival purposes without compensation to me.

Event organizers will use reasonable efforts to respect participant privacy and will not intentionally photograph or record inside changing areas or other areas specifically designated as private.

11.Event Rules and Removal

I agree to comply with Event rules and instructions.

I understand that Event organizers may restrict or terminate my participation without refund if they reasonably believe my conduct creates a safety risk to myself or others, interferes with the Event, or violates Event or venue rules.

12.Colorado Law and Venue

This Agreement shall be governed by the laws of the State of Colorado.

Any legal action arising from this Agreement or my participation in the Event shall be brought in an appropriate court located in Larimer County, Colorado, unless otherwise required by law.

13.Severability

If any provision of this Agreement is determined to be invalid or unenforceable, that provision shall be severed or limited to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
